RESUMO

 A proposta do presente artigo é fazer uma retrospectiva do contexto filosófico-político-cristão em que surgiu a noção de “direitos humanos”, explicitar seus fundamentos, abordando a questão da universalidade dos direitos humanos X o relativismo de sua efetivação histórica, trazendo a lume as grandes correntes filosóficas do pensamento jurídico (Jusnaturalismo e Positivismo Jurídico), e, situar o discurso dos direitos humanos no atual contexto sócio-político da pós-modernidade, o que nos remete a uma mudança paradigmática, de crise dos fundamentos da razão como eixo estruturador da sociedade. Tomamos como referência o pensamento de autores como Doglas Cesar Lucas, Richard Rorty, Jayme Benvenuto, Boaventura de Souza Santos, Flávia Piovesan, dentre outros, perpassando também pelo conceito da Ética da Alteridade em Emanuel Lévinas.  Espera-se como resultado apontar elementos que revelem a falência do Direito dentro de um viés estritamente racionalista e dogmático, com vistas a evidenciar uma nova noção de direitos e de justiça, numa perspectiva jurídica que, embora dogmática, está associada a valor, ética, solidariedade, humanização, em que o legal não ultrapasse o humano e que o homem seja “a medida de todas as coisas”.

ABSTRACT

The purpose of this article is to make a retrospective of the Christian philosophical-political context in which the notion of "human rights" has emerged, explaining its foundations, addressing the issue of universality of human rights vs. the relativism of its historical accomplishment, bringing to light great philosophical currents of legal thought (Natural Law and Positive Law), as well as to situate the discourse of human rights in the current socio-political context of post-modernity, which brings us to a paradigm shift in the crisis of the foundations of reason as society’s structural axis. As reference, we have taken the works of authors such as Doglas Cesar Lucas, Richard Rorty, Jayme Benvenuto, Boaventura de Souza Santos, Flávia Piovesan, among others, as well as touched the concept of Ethics of Alterity in Emmanuel Levinas. The expected outcome is to point elements that reveal the failure of the Law in a strictly rationalistic and dogmatic view, in order to highlight a new notion of rights and justice from a legal perspective which, though dogmatic, is associated with value, ethics, sympathy, humanization, in which the legal does not exceed the human aspect and where man is "the measure of all things."
