RESUMO
O delito de estupro com as alterações produzidas pela Lei n. 12.015/2009, diante da revogação do delito de atentado violento ao pudor, passou a abranger em seu tipo objetivo a descrição do gênero atos libidinosos, o que tem gerado controvérsia doutrinária e judicial sobre a classificação do referido tipo quanto à ação e, em consequência, violação de direitos e princípios fundamentais do condenado em virtude de uma exegese equivocada que está dando azo a condenações desproporcionais e desarrazoadas. O objetivo deste artigo é esclarecer a real classificação tipológica quanto à ação do delito de estupro, enfrentando o problema de se definir de qual se trata e suas implicações, utilizando o método hipotético-dedutivo para se chegar, como resultado, a uma interpretação mais razoável e adequada da classificação preconizada do tipo penal do estupro, o que viabilizará uma aplicação mais racional e equânime da lei penal num Estado Democrático de Direito.

ABSTRACT
The crime of rape with amendments introduced by the Law n. 12015/2009, before the repeal of the offense of indecent assault, was expanded to include in its type the description of gender in sexual acts, which has generated doctrinal and judicial controversy over the classification of this crime as to action and, consequently, violations of fundamental rights and principles od the convict due to a mistaken exegesis that is giving rise to disproportionate and unreasonable sentences. The purpose of this article is to clarify the actual typological classification as to the action of the crime of rape, facing the problem of defining what it is and its implications, using the hypothetical-deductive method to get, as a result, a more reasonable interpretation of the crime of rape, which will enable a more rational and equitable application of criminal law in a democratic State.
