VIOLÊNCIA PSÍQUICA CONTRA A MULHER: A NECESSÁRIA ATUAÇÃO ESTATAL POR MEIO DE POLÍTICAS PÚBLICAS - DOI: 10.12818/P.0304-2340.2012v61p175

Resumo

A mulher, em razão de sua vulnerabilidade e do princípio da dignidade da pessoa humana, goza de proteção especial em (a) Tratados e Convenções Internacionais, na (b) Constituição da República Federal de 1988 e na (c) Lei n. 11340/2006, conhecida como Lei Maria da Penha. Contudo, a mera declaração de direitos não é suficiente para, de imediato, alterar a realidade da violência contra a mulher no ambiente doméstico. Esta pode ser visualizada por meio de atitudes que violam a integridade psicofísica da mulher. A violência tem caráter transgeracional, uma vez que os filhos da vítima, provavelmente, desencadearão esse comportamento nas futuras gerações. Apesar do rigor no tratamento normativo, a violência contra a mulher ainda é uma triste realidade, conforme demonstram pesquisas recentes. A lei em comento deixou de tornar criminosa a violência psíquica apesar de ter tornado mais grave a lesão corporal leve contra a mulher. Em razão do escalonamento da violência, a intervenção do Estado se mostra imprescindível para permitir o rompimento com o ciclo da violência antes que a mulher seja agredida fisicamente ou morta. Por fim, entende-se que o direito à não violência conferido à mulher somente se tornará efetivo no mundo dos fatos quando houver uma mudança de mentalidade e de postura da sociedade que depende de políticas públicas efetivas de prevenção e punição do agressor.

ABSTRACT

The woman, because of their vulnerability and the principle of human dignity, enjoy special protection in (a) international treaties and conventions, in (b) Constitution of the Federal Republic in 1988 and (c) Law no. 11340/2006, known as Maria da Penha Law. However, the mere declaration of rights is not enough to immediately change the reality of violence against women in the household. This can be visualized by means of actions that violate the psychophysical integrity of women. Violence has transgenerational character, since the children of the victim, probably trigger this behavior in future generations. Despite the rigor in the regulatory treatment, violence against women is still a sad reality, as shown by recent research. The statute under discussion failed to make criminal psychological violence despite having made more severe to mild injury against women. Due to the escalation of violence, state intervention proves necessary to allow the breaking the cycle of violence before a woman is physically assaulted or killed. Finally, it is understood that the right granted to non-violence to women only become effective in the world of facts when there is a change of mentality and attitude of the society that depends on effective public policies to prevent and punish the aggressor.
