O ESTADO REGULADOR E O EXEMPLO DO SETOR ENERGÉTICO PAULISTA - DOI: 10.12818/P.0304-2340.2012v61p331
Resumo
Uma visão panorâmica da história revela que a cada momento, a realidade social, política e econômica determina uma conformação específica do aparato estatal. No atual momento, várias atividades assumidas no período do Estado de Bem Estar Social vêm sendo devolvidas aos particulares. Diante dessa realidade, surge a necessidade de se garantir que essas atividades transferidas à iniciativa privada pelo Estado continuarão a atender ao interesse da coletividade. O desafio, portanto, é imprimir valores públicos nas entidades privadas, o que é feito, em grande medida, pela atividade regulatória. O presente trabalho apresenta alguns instrumentos fundamentais de regulação econômica e, por meio da análise de um exemplo tirado do setor energético paulista, mostra a importância do Direito Administrativo para a viabilização de um diálogo entre complexos conceitos da economia e os valores promovidos pelo ordenamento jurídico.

ABSTRACT
A historical overview reveals that at each moment, the social, political and economic caracteristics causes a specific conformation of the state. Presently, various activities undertaken during the period of the Welfare State are returning to private institutions. Given this reality, there is a need to ensure that these activities transferred to the private sector by the state will continue to serve the interest of the community. The challenge therefore is to print public values in private bodies, which is done largely by regulatory activity. This paper presents some fundamental tools of economic regulation and, by analyzing an example taken from the energy sector in São Paulo, shows the importance of administrative law in allowing a dialogue between complex concepts of the economy and the values promoted by the legal system.
