A INFLUÊNCIA DO INCONSCIENTE DO INTÉRPRETE NO PROCESSO DE CONCRETIZAÇÃO DA NORMA CONSTITUCIONAL - DOI: 10.12818/P.0304-2340.2012v61p425

Resumo

Este artigo procurará destacar o papel da pré-compreensão do jurista na interpretação das normas constitucionais. Para tanto, primeiro será desnudada as particularidades que cercam a norma constitucional e, consequentemente, o processo interpretativo que essa sua natureza própria impõe. Serão adotados como referenciais teóricos no campo da hermenêutica, as teorias hermenêuticas concretistas, notadamente, a teoria estruturante do Friederich Müller e a teoria normativa de Konrad Hesse.  A pré-compreensão do intérprete irá ser estudada sob a ótica dos estudos de Freud sobre a mente humana e o inconsciente. Por fim, o mito da racionalidade objetiva e um nova concepção de racionalidade, tendo em conta a figura do inconsciente também será exposta.

ABSTRACT

This article will seek to highlight the role of prior comprehension of the jurist in the interpretation of constitutional norms. To this end, the first will be laid bare the particularities surrounding the constitutional norm and, consequently, the interpretive process that nature itself imposes. Will be adopted as theoretical frameworks in the field of hermeneutics, hermeneutic theories Concrete, notably the theory of structural and normative theory Friederich Muller and Konrad Hesse. The prior comprehension of the interpreter will be studied from the viewpoint of Freud studies regarding the human mind and its conscious . The myth of objective rationality and a new conception of rationality, taking into account the figure of the unconscious will also be exposed.
