O CONTROLE DA JUSTIFICATIVA DO USO DE ALGEMAS APÓS A EDIÇÃO DA SÚMULA VINCULANTE 11 - DOI: 10.12818/P.0304-2340.2012v61p473

Resumo

O trabalho analisa o modo como o Poder Judiciário trata o uso das algemas após a edição da Súmula Vinculante 11 em agosto de 2008. O objetivo é visualizar como deve ser uma atuação efetiva do Poder Judiciário de modo que a Súmula Vinculante não se torne obsoleta e ineficaz no cotidiano dos Tribunais. Para isso, serão apresentados alguns pontos controvertidos e seus fundamentos para uma interpretação de acordo com a finalidade da elaboração da súmula e o dirigismo constitucional, quais sejam: nulidade absoluta da justificativa, abdicação de dano concreto para caracterização da nulidade e verificação fática dos requisitos da Súmula Vinculante. Por fim, conclui-se que a soma desses requisitos são elementos necessários para que a Súmula Vinculante 11 não se torne uma orientação inerte e ineficaz no controle de arbitrariedades cotidianas.

ABSTRACT

The paper analyzes how the Judiciary views the use of handcuffs after the edition of the 11^thBinding Precedent in August 2008. The goal is understand how should bean effective position of the Judiciary so that the Binding Precedent does not become obsolete and ineffectivein everyday Courts. For this, it will be introduced some controversial points and its interpretation bases according to the elaboration purpose of the precedent and the constitutional dirigisme, which are: absolute nullity of the justification, abdication of concrete damage to characterize the nullity and factual verification of the requirements of Bidding Precedent. Finally, we conclude that the total of these requirements are necessary elements for the Binding Precedent 11 does not become an inert and ineffective orientation in controlling  everyday arbitrariness.
