A FUNÇÃO SOCIAL DA EXPLORAÇÃO MINERAL NO ESTADO DE MINAS GERAIS - DOI: 10.12818/P.0304-2340.2013v62p475
Resumo
O presente trabalho pretende analisar a exploração mineral no Estado de Minas Gerais, a fim de verificar se é observada a função social da atividade, tal como dispõe a Constituição da República Federativa do Brasil de 1988. A partir do esboço teórico da função social da exploração mineral, que se materializa na persecução necessária da justiça social e do desenvolvimento socioeconômico, busca-se favorecer uma discussão jurídica sobre as receitas (originárias e derivadas) decorrentes da atividade mineral e analisar os impactos socioeconômicos da exploração mineral, bem como, os efeitos em cadeias fiscais proporcionados pelo Estado. O que se pode verificar é que a atividade minerária não é capaz de propiciar um melhor padrão de bem estar social para o povo mineiro, razão pela qual o marco regulatório do setor mineral carece de revisão para que possa favorecer o cumprimento da função social da atividade.

ABSTRACT
The presented study intends to analyze the mineral exploration in the State of Minas Gerais in order to verify if it’s social function is observed, as provided for by the Constitution of the Federative Republic of Brazil in 1988. From the theoretical outline of the social function of mining, which materializes in the necessary pursuit of social justice and socioeconomic development, we seek to foster a legal discussion about revenues (originating and derivatives) due to mining activity and analyze the socioeconomic impacts mineral exploration, as well as the tax effects chains provided by the state. What can be seen is that the mining activity is not able to provide a better standard of welfare for the people of Minas Gerais, which reason why the regulatory framework for the mining sector needs to be revised so that it can facilitate the fulfillment of the social function of the activity.
