Resumo

O presente trabalho estudará a necessária correlação entre a ordem econômica, em especial a brasileira, e as gerações de direitos fundamentais, de forma a demonstrar que a Constituição Econômica brasileira é o resultado positivado da evolução histórica da ordem econômica mundial, que caminhou paralelamente ao reconhecimento das diversas gerações dos direitos humanos. E, por tais motivos, a análise da ordem econômica, especialmente da ordem econômica brasileira, demanda necessariamente incursão no estudo dos direitos humanos em sua variedade intergeracional, como forma não apenas de afiançar a melhor compreensão histórica de sua formação, como também garantir a efetividade plena dos princípios e fundamentos estatuídos pelas normas econômicas. Nossa exposição dar-se-á pela análise comparativa entre as três gerações de direitos fundamentais e o caminhar da evolução da disciplina econômica no plano internacional e brasileiro, valendo-nos, para tanto, de viés essencialmente dogmático, com ênfase na dimensão analítica.

ABSTRACT

This paper will examine the necessary correlation between the economic order, in particular the Brazilian one, and generations of fundamental rights, in order to demonstrate that the Brazilian Economic Constitution is the result of historical evolution of the global economic order, which walked alongside the recognition of several generations of human rights. And, for such reasons, the analysis of the economic order, especially the Brazilian economic order, demand necessarily foray into the study of human rights in their intergenerational variety as a way not only to secure a better understanding of its formation, but also ensure the full effectiveness of the principles and statutory standards economic fundamentals. Our study will be by the comparative analysis between the three generations of fundamental rights and the walk of the evolution of economic discipline in the Brazilian and international plan.
