BEYOND THE TRADITIONAL MECHANISMS OF SOCIAL PARTICIPATION IN THE BRAZILIAN JUDICIAL REVIEW

Abstract

Based on the diagnosis that the spaces designated for social participation in the Brazilian judicial review are mostly restricted to interventions by amici curiae and public hearings, seek to substantiate the need for mechanisms that go beyond the traditional boundaries. The central concern lies more in justifying this perspective than necessarily presenting “new mechanisms”. The research method is predominantly bibliographic in nature. To this end, the paper is structured into four sections that seek to (i) describe the participatory spaces of traditional mechanisms, (ii) identify their documentary evidence, (iii) point out their impacts and (iv) some of their participants. The results confirmed the initial hypothesis and suggest that research should continue to suggest mechanisms and social actors beyond the traditional ones. Finally, the conclusions are presented.
