Resumo

A ascensão do direito foi um dos mais importantes vetores do desenvolvimento do estado moderno. A invenção do controle de constitucionalidade para efetivação dos direitos projetou o Judiciário e implicou um novo equilíbrio entre os poderes do estado. A redefinição dos espaços de atuação do direito e da política, para não amortecer a democracia, exige engenharia institucional que previna a supremacia judicial. O sistema de jurisdição constitucional brasileiro supre o mau funcionamento do Poder Legislativo, mas sufoca o desenvolvimento de uma cultura política que solucione esse problema pela via natural. Essa conjuntura impõe urgentes reforma judiciária e política que assegurem a efetividade concomitante da jurisdição constitucional e do sistema político.

The rise of the law was one of the most important vectors of the development of the modern state. The invention of judicial review has leveraged the judiciary and led to a new balance between the powers of the state. The redefinition of the performance spaces of law and politics requires institutional engineering that prevents judicial supremacy damping democracy. The Brazilian system of judicial review counterbalances the malfunction of the Legislature, but stifles the development of a political culture that solves this problem by natural means. This situation requires urgent political and judicial reform to ensure the effectiveness of both judicial review and political system.
