Resumo

O presente trabalho investiga o tema central da obra de Konrad Hesse: a força normativa da constituição, cujas raízes estão na sua crítica às concepções de Ferdinand Lassalle acerca da definição de constituição (constituição escrita ou “pedaço de papel" e constituição real ou “fatores reais do poder”). Hesse trabalha com os conceitos de constituição jurídica e “vontade de constituição”, sendo que para ele o ordenamento constitucional é condicionado, mas também força condicionante da realidade fática e das relações de poder existentes no seio da sociedade. E é nessa interdependência que se tem tanto as possibilidades, quanto os limites da força normativa da constituição. Ao lado desse tema central, também se investiga outro tema não menos relevante, que é a temática da mutação constitucional. Mesmo porque, são temas interligados, considerando-se que os limites à mutação constitucional são delineados pelo próprio texto normativo e se prestam à preservação da seriedade e função normativa da constituição jurídica.

ABSTRACT

This work investigates the central theme of the work of Konrad Hesse: the normative force of the constitution, rooted in his criticism of Ferdinand Lassalle conceptions about the definition of constitution (written constitution or “piece of paper” and real constitution or real factors of power). Hesse works with the concepts of juridical constitution and “will constitution ”, and for him, the constitutional order is conditioned, but also is a determinant strength of the factual reality and power relations within society. And in this interdependence can be found the possibilities and the limits of the normative force of the constitution. Alongside this central theme, also investigates another subject not least important, that is the issue of constitutional mutation. After all, they are interconnected issues, considering that the limits of constitutional mutation are outlined by the normative text.
