Resumo

O presente artigo analisa a inserção do poder constituinte em um contexto históricocultural, à luz de uma teoria reconstrutiva da Constituição. Tal análise implica a reapreciação da distinção clássica entre o poder constituinte originário e o poder constituinte derivado, de
forma a propiciar uma releitura do fenômeno da “autoridade criadora” da Constituição no limiar entre constitucionalismo e democracia. Com base na premissa da problematização teórica da teoria do poder constituinte, reexamina-se a experiência constitucional brasileira pós-1964, com enfoque no tratamento dado ao problema constituinte durante o regime militar e no significado da Assembleia Nacional Constituinte de 1987/88, com vistas à redefinição de diretrizes para o pensar histórico-jurídico do processo de constitucionalização e redemocratização do Brasil. A reconstrução que se propõe envolve, em síntese, o questionamento quanto à maneira pela qual o Estado Democrático de Direito e sua existência no Brasil tornaram-se exigíveis, o rompimento com a perspectiva tradicional de acordo com a qual a problemática da legitimidade e da efetividade constitucionais é raciocinada a partir de um hiato entre um suposto idealismo da Constituição e uma realidade social recalcitrante, e a recolocação historiográfica de uma racionalidade normativa já presente e vigente nas práticas político-constitucionais cotidianas.

This article analyses the assimilation of constituent power into a historical and cultural context, in light of a reconstructive theory of the Constitution. This analysis implies a reconsideration of the classical distinction between the original constituent power and the derived constituent power, in order to provide a reinterpretation of the phenomenon of the “creative authority” of the Constitution on the threshold between constitutionalism and democracy. Based on the theoretical premise of questioning the theory of constituent power, the paper examines the constitutional experience of post-1964 Brazil, focusing on the treatment given to the constituent problem during the military regime and on the meaning of the National Constituent Assembly of 1987/88, aiming to set new standards for the legal-historical thinking of the process of constitutionalization and democratization of Brazil. The (re)construction proposed involves, in short, questioning the way through which the democratic State of law and its existence in Brazil became payable, breaking with the traditional view according to which the problem of constitutional legitimacy and effectiveness is reasoned from a gap between the idealism of the Constitution and a recalcitrant social reality, and historiographically reallocating the normative rationality already present in the political and constitutional practices.
