POLITICS, PERSONALITY RIGHTS, AND THE FREEDOM OF SPEECH AND EXPRESSION IN LGPD PROTECTION

This study aims to consider personality rights. It is faced that through years, Politics has revealed itself as an important instrument of creation and affirmation of rights. The paper aims to discuss freedom of speech and expression that is considered one of the elements of General Law for Protection of Personal Data. It is used the hypothetical-deductive method based on printed texts from Brazilian and foreign principles. It is expected as a result, to identify the existence of suitable juridic handling to freedom of speech and expression in LGPD. This article is divided into three parts. The first one is focused on politics as an instrument for the affirmation of rights. The second sustain the necessity of a new normative category of should-do to the comprehension of the personality rights. The third describes as the LGPD dealt with the freedom of speech and expression, which is considered a personality right.
