ON THE CREATION OF THE REPUBLIC AND THE EFFECTIVENESS OF THE CONSTITUTION (1825-1830)

Abstract

The creation of the Eastern State of Uruguay
was the consequence of a complex process
that has been widely studied by national
historiography. Therefore, Uruguayan
constitutionalists are dedicated to uncovering
administrative organization and consecrating
two fundamental rights in the first Magna
Carta, providing a technical approach
that dispenses with the analysis of factual
circumstances that hinder its effectiveness.
In this sense, the work aims to analyze the
Uruguayan Constitution of 1830 not only as
a strictly legal problem, but as a historical
problem, which we will address through
the exposition published by Juan Antonio
Lavalleja in 1833, in order to study the process
of creation of The Republic and analyze the
meaning of the Constitution in the political
discourse in the first years of the Eastern State.
