ADOÇÃO E DIREITOS FUNDAMENTAIS: A ADOÇÃO COMO EFETIVAÇÃO DA CONVIVÊNCIA FAMILIAR

Resumo

Em tempos de repensar os institutos do Direito Civil, anteriormente cingidos nas amarras do patrimônio, visa-se à sua adequação à nova ordem fundada pela Constituição Federal de 1988.  Remodelados pela constitucionalização, passam a encerrar um novo fundamento: a pessoa humana. Assim, num movimento de evolução, sai o patrimônio e passa a figurar a pessoa no centro de suas órbitas, mas entendida não como indivíduo, e sim como sujeito de direitos e deveres voltados à sua plena realização. Torna-se clara tal evolução quando investigado um instituto em particular, é o que se fará no presente trabalho tendo como condutor o instituto da adoção que, presente em várias culturas e épocas, é capaz de demonstrar em suas mudanças e em sua forma atual que o Direito Civil tem na pessoa humana e na consecução de sua dignidade o seu mister mais valioso.

ABSTRACT

We live a time of reformulation of Civil Law. Formerly connected to the concept of ownership, Civil Law needs, nowadays, to be adjusted to meet the requirements created by the institution of the new Federal Constitution Law in 1988. In order to be in accordance with Constitutional Law, its central concept will be no more the one of possession, but the individual human being, subjected to rights and obligations. The present study intends to show there has been a clear evolution of Civil Law, by analyzing a particular institute: the legal proceeding of adoption. Adoption has been a reality in many cultures, since old times. The changes occurred in its legal process, as well as its present state, demonstrate that, at present times, Civil Law has the individual human being as its principal and most valuable target, searching for human dignity and a plain quality of life for all.
