RESUMO

 O presente artigo trata do instituto da federalização das graves violações aos direitos humanos, buscando levantar as principais controvérsias em torno do incidente de deslocamento de competência, mediante o qual se transfere a pedido do Procurador-Geral da República examinado pelo Superior Tribunal de Justiça (STJ), a competência da esfera estadual para a federal dos processos envolvendo graves violações aos direitos humanos. A matéria esbarra em várias questões controvertidas e ainda não harmonizadas na doutrina e jurisprudência. O estudo procura retratar o estado da obra na doutrina e jurisprudência nacional, apontando as principais lacunas que dificultam a melhor compreensão do instituto.

ABSTRACT

 This article comes from the institute of federalization the human rightsʹ serious violations, seeking to identify the main controversies surrounding the incident displacement of competence the jurisdiction of the sphere state to federal cases involving human rightsʹ serious violations, whereby it transfers the request of the Prosecutor General's Office examined by Superior Tribunal de Justiça (STJ/Brazil). The article touches on several controversial issues and not yet harmonized in doctrine and jurisprudence. The study seeks to portray the state of the work in doctrine and national jurisprudence, pointing out the main gaps that hinder the understanding of the institute.
