Resumo

O trabalho tem por objeto a teoria da reinvenção dos direitos humanos. Mais precisamente, objetiva uma crítica jurídica e epistemológica do Direito Internacional dos Direitos Humanos, efetivamente da Declaração Universal de 1948, em razão do idealismo da condição de humano a-histórico dotado abstratamente de direitos. Focando-se na realidade latino-americana, proceder-se-á uma análise da conformidade da Declaração à realidade imanente na qual se desenvolve a vida. A importância dessa apreciação reside na necessidade de uma visão concreta do humano, como um ser com necessidades, rompendo-se com a lógica idealista. Existem limites ao idealismo, a saber, o humano concreto e contextual, que necessita de bens para uma vida digna. Permanece, então, uma importância de perceber que os direitos humanos, produtos culturais surgidos das relações das pessoas concretas com o entorno para a manutenção da dignidade, são perpassados por diversos fenômenos (complexidades): sendo influenciado economicamente, politicamente, ambientalmente, etc. Com base na realidade latino-americana, intentar-se-á argumentar a teoria da reinvenção de Herrera Flores, como forma de se pensar uma noção dos direitos que seja emancipatória e de empoderamento.

ABSTRACT

The work focuses on the theory of reinvention of human rights. More precisely, it objectives the legal and epistemological critique of International Law of Human Rights, effectively the Universal Declaration of 1948, due to the idealism of the human condition, endowed abstractly and ahistoricaly by rights. Focusing on Latin American reality, it will make a review of reality in which life develops. The importance of this consideration is the need for a concrete vision of the human as a being with needs, breaking with the idealist logic. There are limits to idealism, namely, the concrete and contextual human, which requires assets to a dignified life. It remains, then, an important to realize that human rights, cultural products emerged from the concrete relationships of people with the environment for the maintenance of dignity, are steeped for several phenomena (complexity) being influenced economically, politically, environmentally, etc.. Based on the Latin American reality, it will bring to argue the theory of reinvention Herrera Flores, as a way of thinking about a notion of rights that is emancipatory and empowerment.
