Resumo

RESUMO

 O constitucionalismo latinoamericano é um movimento marcado pela defesa de causas sociais específicas, muitas vezes esquecidas pelos Estados europeus que formaram a base de muitas Constituições latinas ao longo da história. Ocorre que as comunidades tradicionais, dessa região, como os indígenas, ou mesmo, os caboclos, os quilombolas, pescadores artesanais, etc. não estavam recebendo a devida proteção constitucional. Por esse motivo, nas últimas décadas alguns Estados latinoamericanos atentaram de uma forma mais efetiva e justa para um problema histórico que, igualmente, está vinculado à proteção com a biodiversidade. Dessa forma, o texto pretende apresentar os limites e perspectivas de um sistema “sui generis” de tutela aos direitos fundamentais das comunidades tradicionais, como sendo uma maneira de defender o próprio sentido e vocação do constitucionalismo latinoamericano.

ABSTRACT

 The Latin American constitutionalism is a movement marked by specific social cases, that are often forgotten by European states which formed the basis of many Latin Constitutions throughout history. It occurs that the traditional communities in this region, like indigenous people, or even caboclo people, quilombola people, and artisanal fishermen, etc.. were not receiving the proper constitutional protection. For this reason, in recent decades some Latin American States have pointed in a more effective and fair way to a historical problem that also is linked with biodiversity protection. Therefore, the text intends to present limits and perspectives of a "sui generis" protection of fundamental rights of traditional communities, as a way of defending the sense and the vocation of Latin American constitutionalism.
