A BUSCA DA LEGITIMIDADE DEMOCRÁTICA PELO MODELO JUDICIAL BRITÂNICO

Resumo

O presente artigo pretende retomar o debate entre o judicial review e a supremacia legislativa. Ambos sofrem pesadas críticas, podendo-se apontar que, enquanto o regime de supremacia do legislador demonstrou-se historicamente incapaz de proteger as minorias das maiorias ocasionais, o judicial review, prevalente na ampla maioria dos países de hoje, é questionado quanto à legitimidade democrática de suas decisões judiciais. Transversalmente a estes dois modelos, surge, no Reino Unido, em 1998, um terceiro que pretende aproveitar as vicissitudes de cada um, potencializando seus pontos positivos e equalizando os negativos. Esta sistemática adotada pelo Reino Unido será analisada no presente artigo de modo a demonstrar, ao final, as restrições contextuais que impedem a sua aplicação à realidade brasileira. Abstract

This article intends to resume the debate between judicial review and legislative supremacy. Both suffer heavy criticism and can be pointed out that while the scheme of supremacy of the legislature has shown itself historically incapable of protecting minorities from casual majorities, the judicial review, widely prevalent in most countries today, is questioned about the democratic legitimacy of their judgments. Across these two models, arises, in the UK, in 1998, a third party willing to take the vicissitudes of each, increasing its positives and negatives equalizing. This system adopted by the United Kingdom will be reviewed in this article in order to demonstrate the contextual constraints that prevent their application to the brazilian reality.
