Resumo

A inviolabilidade da intimidade, direito fundamental consagrado na Constituição da República, é ampla, abrangendo todos os aspectos da vida da pessoa, incluindo, portanto, não só a proteção de seus atos, como também daquilo que é escrito, caso da correspondência, instrumento essencialmente voltado à expressão da intimidade dos sujeitos. Neste contexto, tem-se que tanto as mensagens eletrônicas quanto as correspondências tradicionais podem encerrar informações de âmbito reservado, amparadas pelo direito à intimidade. É fundamental, portanto, que as duas espécies de mensagens sejam juridicamente tuteladas. Propõe-se o presente trabalho justamente a investigar qual o alcance da proteção do conteúdo da correspondência tradicional, no que tange à intimidade dos sujeitos envolvidos, e a possibilidade de sua ampliação à correspondência eletrônica, propiciando, assim, a proteção jurídica do conteúdo da mensagem.

ABSTRACT

The right to privacy, a fundamental right guaranteed by the Brazilian Constitution, grants a broad protection, which includes all aspects of persons’ lives such what they do and write, which includes their mail, that are means essentially used for the expression of someone’s intimate thoughts. In this context, it is easy to see that both regular mail, such as letter, and electronic mail may contain private information which should be protected by the right to privacy. It is fundamental, therefore, that both kinds of messages are legally protected. With this paper we propose to investigate the range of the protection of the content of the traditional mail, in which concerns the privacy of the people involved, as well as the possibility of using such protection in relation to electronic mail, which would allow, as a result, the protection of the content of the e-mails.
