PHILOSOPHICAL AND LEGAL BASIS OF SOLIDARITY

The aim of this text is to analyze the
philosophical category of care from a
Heidegger perspective as the foundation of
solidarity in the legal dimension. This is due
to the fact that Heidegger designates care as
being-in-the-world, linking the relationship
of care with oneself and with the world,
interconnecting life as a whole. Based on this
understanding, there is a direct relationship
with solidarity (also as a normative
command), since being supportive implies
taking responsibility for one’s own life and for
the world around them, constituting a legal
right and duty. Thus, solidarity, even in the
legal sphere, manifests care for oneself and for
others. It manifests the individual and social
dimensions. The method used is deductive
because, by establishing some parameters of
Heidegger’s theory, the elements linked to
the conception of Law adopted in this work
were located. The research instruments, as
required by the nature of the subject, were
bibliographical.
