Resumo

O presente estudo tem como escopo a análise da evolução do entendimento jurisprudencial, especificamente no âmbito do Superior Tribunal de Justiça, acerca dos temas multa coercitiva, redução do valor e efetividade das decisões judiciais. Nesta esteira, tendo como paradigmas os recentes julgados proferidos por aquela Corte, será objetivado em caráter especial o estudo da efetividade das ordens judiciais. Tal estudo desdobra-se na problematização da questão, no sentido de suscitar uma reflexão crítica acerca da realidade posta ao entorno da multa coercitiva e a dificuldade de se efetivar uma decisão emanada do Poder Judiciário, consagrando um verdadeiro desrespeito à ordem e consequente afronta à própria Democracia.

ABSTRACT

The present study has the objective analysis of the evolution of jurisprudential understanding, specifically in the Superior Court of Justice on issues of coercive fines, reducing the value and effectiveness of judicial decisions. On this track, with the recent paradigms as judged by that court rulings, special character is objectified in the study of the effectiveness of court orders. This study unfolds in the problematic of the issue, to raise a critical reflection of reality brought to the coercive environment of the fine and difficult to enforce a decision issued by the judiciary, establishing a real disregard for order and consequent affront to democracy itself.
