Resumo

O presente trabalho tem por escopo demonstrar os objetivos e funções da Convenção Americana de Direitos Humanos na proteção jurisdicional dos direitos humanos. A partir da análise do julgamento da ADPF nº 153 em cotejo com a decisão proferida pela Corte Interamericana no caso Gomes Lunde, pretende-se demonstrar o descompasso de parte da doutrina e jurisprudência nacionais em relação aos propósitos da Organização dos Estados Americanos e da Constituição da República de 1988, bem como propor visões alternativas na solução de conflitos entre ordem jurídica nacional e transnacional.

ABSTRACT

The present work has the purpose to demonstrate the objectives and functions of the American Convention on Human Rights on the judicial protection of human rights. From the analysis of the judgment delivered in ADPF nº153 in comparison with the decision of the Inter-American Court in Gomes Lunde case, this article argues the mismatch of some sections of doctrine and judges with regard to the purposes of the Organization of American States and the Constitution of Republic 1988, and propose alternative visions in solving conflicts between national and transnational legal order.
